These Terms of Service (“Terms”) govern access to and use of the Shootr mobile application, website, and related services operated by Shootr LLC (“Shootr,” “we,” “us,” or “our”). By creating an account, accepting these Terms in the app, or using Shootr, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Shootr.
Eligibility and accounts
You must be at least 18 years old and legally able to enter a binding agreement to create an account or use Shootr. You must provide accurate information, maintain only accounts you are authorized to use, safeguard your credentials, and promptly update information that becomes inaccurate. You are responsible for activity conducted through your account. Notify Shootr promptly if you believe your account has been compromised.
Shootr may require email, payment-provider, identity, business, or other verification when necessary for a feature. A badge or completed verification step is not a guarantee of a person’s identity, conduct, qualifications, licensing, insurance, or safety unless Shootr expressly states otherwise.
Shootr’s marketplace role
Shootr provides technology that helps Clients and Creatives discover each other, communicate, request and manage bookings, process payments, use live-job tools, and deliver creative work. Clients and Creatives—not Shootr—decide whether to enter a service arrangement and are responsible for the services they request, provide, or receive.
Unless Shootr expressly agrees otherwise in writing, Shootr does not employ Creatives; direct or control their artistic work; guarantee a booking, result, user, location, equipment, or service; or act as an insurer, talent agency, emergency service, or law-enforcement agency. Users are responsible for licenses, permits, releases, insurance, taxes, and other requirements applicable to their activity.
Bookings and user agreements
A booking request is not confirmed merely because it is submitted. The applicable Creative must accept it, and any required Client payment must be successfully completed. The app may show availability, estimates, distances, directions, reminders, or status information, but users must independently confirm material details such as scope, deliverables, duration, price, meeting address, access, deadlines, usage rights, and special requirements.
The booking record and any written terms agreed by the Client and Creative form their service arrangement. Users must communicate changes promptly, avoid double-booking, and use Shootr’s booking and payment tools honestly. Cancellation, completion, no-show, refund, dispute, and payout rules shown in the app or an incorporated policy apply to that booking.
Payments, fees, payouts, and taxes
Stripe provides payment-processing and connected-account services. Payment processing services for Creatives on Shootr are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the applicable Stripe Services Agreement. By using Stripe-connected payment or payout features, you agree to the applicable Stripe terms and authorize Shootr and Stripe to exchange the account and transaction information needed to provide those features. Stripe processes personal data under Stripe’s Privacy Policy.
Shootr may charge platform fees disclosed before or in connection with the applicable transaction. Fee tiers, eligibility, payment-processor fees, taxes, refunds, chargebacks, reserves, negative balances, and payout timing may affect the amount a Creative receives. Creatives are responsible for providing accurate payout and tax information and for their own tax obligations. Shootr does not store full payment-card or bank-account credentials.
Live jobs, location, and safety tools
Live-job tools may provide directions, status updates, timing, messaging, and permission-based location sharing between users connected to a confirmed booking. Location information can be delayed, inaccurate, or unavailable and must not be relied upon as the sole source of safety or emergency information. Stop sharing and contact emergency services when appropriate.
If Shootr offers safety-audio recording, the person starting a recording is responsible for giving any required notice and obtaining all legally required consent before recording. Do not record where consent is absent or recording is unlawful. Shootr’s safety features do not guarantee prevention, monitoring, rescue, evidence preservation, or emergency response.
User content and licenses
You retain ownership of content you create and upload. You grant Shootr a worldwide, nonexclusive, royalty-free license to host, store, reproduce, process, transmit, display, format, moderate, and make technical copies of that content only as reasonably necessary to operate, secure, improve, and provide the features you choose. This operational license ends when the content is deleted, except for cached copies, content shared with others, safety or legal holds, backups, and records Shootr must reasonably retain.
You represent that you own or have all rights, permissions, releases, and consents needed to upload, display, deliver, and authorize the intended use of your content, including rights involving music, trademarks, locations, property, and people appearing in the work. Do not upload confidential information or another person’s private information without authorization.
Clients and Creatives must agree before the job to any restrictions involving confidentiality, portfolio display, social-media use, likeness, commercial use, exclusivity, editing, or delivery. A booking checkbox does not override applicable law or rights held by a person who did not grant permission.
Shootr Delivery
Shootr Delivery helps authorized booking or conversation participants transmit files. Users remain responsible for file contents, rights, backups, delivery deadlines, device compatibility, and preserving their own originals. Shootr is not a permanent archive and may apply size, format, access, or retention limits disclosed in the service. Do not use Shootr Delivery to distribute malware, infringing content, unlawful material, or files unrelated to an authorized purpose.
Gear listings
Users are responsible for the accuracy, legality, ownership, condition, and safety of gear they list. Unless Shootr expressly launches a protected transaction feature, a gear listing is informational and Shootr does not inspect items, hold purchase funds, guarantee a trade or sale, or provide buyer or seller protection. Do not list stolen, counterfeit, recalled, illegal, dangerous, or prohibited items.
Prohibited conduct and content
You may not use Shootr to harass, threaten, stalk, discriminate, exploit, impersonate, defraud, dox, or harm anyone; evade a block or enforcement action; interfere with the service; scrape or collect data without authorization; introduce malicious code; gain unauthorized access; manipulate bookings, ratings, payments, or reviews; or conduct unlawful activity.
You may not upload or attempt to upload pornography, sexually explicit material, sexual exploitation, any sexual content involving a minor, child sexual abuse material, nonconsensual intimate imagery, illegal material, credible threats, hateful content, stolen work, infringing content, deceptive listings, or content that creates a serious safety risk. Shootr may automatically screen content before publication, prevent publication, remove content, limit distribution, retain safety records, and report information when legally required.
Moderation, reports, blocks, strikes, and appeals
Users can report content or accounts and block other users through available controls. An attempted or completed violation may result in a warning, strike, content removal, reduced visibility, feature restriction, suspension, or termination. Severe conduct may result in immediate action without prior warning. Shootr may preserve relevant records while investigating a report, appeal, fraud concern, payment dispute, safety incident, or legal request.
Automated systems can make mistakes. A user may request review of an eligible moderation action through Shootr support. Submitting an appeal does not require Shootr to restore content while review is pending.
Copyright and intellectual property
Respect intellectual-property rights. If you believe content infringes rights you own or are authorized to enforce, send a sufficiently detailed notice to Shootr support identifying the work, the allegedly infringing material, your contact information, a good-faith statement, and a statement of accuracy and authority. Shootr may remove disputed material and act against repeat infringers. False or abusive notices may create liability.
Account deletion, suspension, and termination
You may request account deletion in the app or through our account-deletion page. Active bookings, payment obligations, disputes, or safety holds may need to be resolved first. Deletion may not remove records Shootr must retain for payment, tax, accounting, fraud prevention, chargebacks, disputes, safety, security, or legal compliance.
Shootr may restrict, suspend, or terminate access when reasonably necessary to protect users or the service, investigate suspected misconduct, comply with law or provider requirements, prevent fraud, or enforce these Terms.
Third-party services
Shootr relies on third-party services for functions such as hosting, authentication, storage, maps, notifications, automated moderation, and payments. Their terms and privacy practices may apply when you use their services. Shootr is not responsible for a third party’s independent acts, outages, or services to the extent permitted by law.
Related policies
These Terms incorporate Shootr’s Community Guidelines, Booking Policy, Payments & Payouts Policy, Safety & Location Policy, and Copyright Policy. If a related policy conflicts with these Terms, these Terms control unless the related policy expressly states otherwise.
Disclaimers and limitation of liability
Shootr is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that Shootr will be uninterrupted, error-free, completely secure, or that users, services, locations, files, or results will meet expectations. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
To the maximum extent permitted by law, Shootr LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, or losses arising from user-to-user conduct or transactions. The enforceability and scope of any liability limitation depends on applicable law.
Changes
We may update these Terms as Shootr changes. We will post the updated version, revise the effective date, and provide additional notice when required. Material changes apply prospectively from their stated effective date. Continued use after the effective date constitutes acceptance where permitted by law.
